Deferred Traffic Prosecution
Deferred Traffic Prosecution, a new program for resolving traffic infractions, is now available for those who meet certain criteria (HB0139).
Are you eligible?
- You need an eligible traffic citation received within the last 21 days
- You can log into MyCase to find out if your traffic citation is eligible
- You need to be 21 or older
- You need to have a valid Utah driver's license (commercial licenses aren't eligible)
- You can't have any felony traffic violations, traffic violation, or traffic violation convictions within the last 24 months
- You can't already be participating in Deferred Traffic Prosecution

Overview
The Garfield County Justice Court is responsible for court matters related to Garfield County Sheriff’s Office, Utah Highway Patrol and Department of Wildlife Resources (DWR) arrests and citations that are class B or C misdemeanors or infractions.
For small claims, the Justice Court settles monetary legal disputes that do not exceed $11,000.00. In order to sue for small claims court action in Garfield County, the defendant must reside or the debt must have occurred within the county’s geographical boundaries.
The Uniform Bail Schedule, which has the most comprehensive list of violations, can be found.
For all citations in Garfield County or Panguitch City that are traffic infractions please do the following:
- Call 435-676-1115 or email justicecourts@garfield.utah.gov to see if you are eligible to be qualified for a Traffic Plea in Abeyance, you will need your citation number.
- You must pay your fine amount, plus a $25.00 Plea in Abeyance fee.
- You must sign and return the Plea in Abeyance form within 10 days.
- Scanned copies or cell phones pictures acceptable if emailed or faxed.
- After 90 days from date you return your signed Plea in Abeyance Agreement and once you have submitted a copy of your driving record. If there are no more citations and you’ve complied with all other conditions of your Plea in Abeyance Agreement, your charge will be dismissed.

If you have already paid your fine your charge is “of record” and you are not eligible for a plea in abeyance.
For all citations that are considered mandatory appearance please contact the court at 435-676-1115 or email justicecourts@garfield.utah.gov to schedule your court appearance and update your contact information. You are required to appear for all court appearances as notified by the court. If you fail to appear when notified, a warrant MAY be issued. Please keep the court informed of your current mailing address, email address, and phone number as long as your case is active with this court. All hearings, except trials, can be attended remotely via a WebEx link.
